Terms of Use

1. Operator and scope

These terms apply to ellingyachts.us, its website tools and Courtesy Games, private proposal pages, and the Elling Yachts Buyer Guide operated by Rockharbour Yachts LLC, doing business as Elling Yachts USA (we, us or our). They do not govern unrelated businesses or replace a separately signed yacht purchase, brokerage, service or other agreement.

By using these services, you agree to these terms to the extent permitted by applicable law. If you do not agree, please stop using them. Our Privacy Policy explains the associated information handling.

2. Yacht information and independent checks

Website and buyer-guide information supports research and discussion. Specifications, dimensions, performance figures, range estimates, equipment, photographs, prices, availability, delivery dates and show details can change and may vary by model year, individual yacht, loading and selected options. Images can show optional equipment.

Confirm the current written specification, price, taxes, delivery terms, availability and included equipment with us before relying on them for a purchase. Review the individual yacht and obtain appropriate independent survey, technical, legal, tax, insurance or financing advice for your circumstances.

Published range, stability and self-righting demonstrations do not guarantee the safety or performance of any voyage. These services are not navigation tools, weather or route-planning services, safety certification, survey reports or operating instructions. The owner and skipper remain responsible for safe operation and voyage decisions.

3. Buyer guide and automated concierge

The Elling Yachts Buyer Guide uses a maintained catalog of public yacht information, clearly attributed operator-provided references and simplified planning comparisons. The website’s virtual concierge provides automated guidance. Outputs can be incomplete, outdated or mistaken and should be checked against their sources and current factory or representative confirmation.

A fit check is an initial screening aid, not a guarantee of bridge clearance, route suitability, marina access, offshore capability or compliance with a rule or certification. Allow for actual measured dimensions, fuel and equipment load, tide and water level, removable structures, local conditions and appropriate safety margins.

The buyer guide is read-only. It does not reserve a yacht, submit a sales inquiry, send a message, execute a contract, place an order or take payment. When used through ChatGPT, OpenAI’s applicable terms and account requirements also apply. We operate the guide independently; its availability does not imply OpenAI’s endorsement of a yacht or a sales claim.

4. Inquiries, appointments and private proposals

Submitting a quotation inquiry, proposal response or appointment request communicates your interest. It does not, by itself, create a binding purchase agreement, confirm a boarding time, guarantee availability or obligate either party to complete a sale. An appointment is arranged separately with you; boat-show admission may be separate.

A purchase and its commercial terms are governed by the formal agreement executed by the relevant parties. These website terms do not change an existing signed agreement or an applicable manufacturer’s written warranty.

Online proposals are available for 30 days from issue unless we approve an extension. Contact Jack to request another 30 days; signing in again does not renew access. Access ends at the end of the applicable expiry date in the America/New_York time zone. Expiry prevents further online access but does not delete the underlying records or copies already downloaded.

Private proposals are intended for their authorized recipients. Do not bypass access controls or use someone else’s email address to gain access. Respect any confidentiality notice accompanying a proposal. If you receive access in error, contact jb@ellingyachts.us.

5. Responsible use and materials

Use the services lawfully. Do not impersonate others, submit information you are not entitled to share, upload malicious content, interfere with the services, attempt unauthorized access, or misuse private information. Submit only information reasonably needed for your inquiry or tool request.

Website text, photographs, videos, logos, brochures, software and other materials belong to us or their respective owners. You may view the materials and share public page links for lawful research. Further reproduction or commercial use requires the rights-holder’s permission unless applicable law permits it. Public access does not transfer ownership of intellectual property.

You remain responsible for the information you submit. Submitting an inquiry permits us to use its contents to respond and carry out the requested follow-up as described in the Privacy Policy; it does not grant us ownership of your material.

6. Courtesy Games

Courtesy Games are free recreational features. They do not offer wagering, cash prizes or items redeemable for money. Game progress and availability are not guaranteed. Backgammon can save your chosen player name and game state; your opponent can see information needed to play. Use a nickname if you prefer and share invitation links carefully.

7. Third-party services and links

The services may use or link to hosting, form-delivery, video, analytics, factory, show and other third-party services. Those providers have their own terms and privacy practices. Check the relevant provider’s current information before making a booking, purchase or other commitment on another site.

8. Availability and your legal rights

We may update, correct, suspend or discontinue website features or the guide. Free informational features and games are provided on an as-available basis. We cannot promise uninterrupted operation, error-free automated outputs or that every item is current.

Nothing in these terms excludes or limits a right, warranty, remedy or liability that applicable law does not permit to be excluded or limited. These terms do not replace promises or obligations in a separately signed agreement.

9. Changes and contact

We may revise these terms by posting an updated version with a revised date. Any additional notice or agreement required by applicable law will still be required. Changes do not amend an existing signed yacht purchase or other contract.
