Privacy Policy

1. Who we are and what this covers

Rockharbour Yachts LLC, doing business as Elling Yachts USA (we, us or our), operates ellingyachts.us and the Elling Yachts Buyer Guide. This notice covers those services, including website inquiries, private proposal pages, the virtual concierge and Courtesy Games hosted on this website. It does not cover unrelated services operated under other business names.

2. Information handled on the website

• Inquiries and quotations. Forms ask for information such as your name, email, phone number, location, yacht or model interest, cruising plans, equipment preferences, purchase or delivery timing, trade-in details, message and permission to contact you. Only the fields relevant to the form are requested.
• Boarding and showing requests. We receive your contact details, preferred date or time, party size, yacht interest and any message. A request lets us arrange the appointment with you; it is not an automatically confirmed reservation.
• Form context. Submissions can include the page URL, referring page, marketing-campaign parameters and submission time so we can understand and respond to the request.
• Private proposals. We check the email address you enter against the proposal’s authorized addresses. Viewing a proposal, downloading its PDF, or opening its print dialog can notify your representative. These notifications include the client’s name and email, proposal identification, date and quoted amount, activity and time. A proposal response includes your selected next step and comments.
• Virtual concierge. The automated website conversation uses responses built into the website. Conversation text is held in the page while you use it. If you choose to send an inquiry to Jack, the form includes the concierge transcript, contact details, preferred reply method, yacht interest, purchase timing, message and source page.
• Technical and usage data. Hosting and delivery providers process requests needed to serve and secure the website. Google Analytics receives public-website activity and technical information, including pages and interaction events, browser/device information and identifiers used for analytics. Google Analytics is not loaded on private proposal pages; named view/download notifications to your representative remain separate. See the cookies and providers sections below.

Please do not enter passwords, payment-card details, government identification numbers, health information or other sensitive information in these forms or in the buyer guide.

3. Elling Yachts Buyer Guide in ChatGPT

The buyer guide provides read-only yacht information and planning comparisons. Its tools process a short search query, a comparison focus, an E4 or E6 model choice, a cruising-goal category, and optional length, beam, draft or air-draft limits. ChatGPT sends the tool arguments needed for your request to the guide, and the guide returns its results to ChatGPT.

The guide checks a platform-provided authenticated-user identifier to allow an authorized request. Its application code does not save that identifier, read your account name or email, create a customer profile, collect leads, place orders or take payments. A free-text search can contain personal information if you put it there, so please use yacht-related search terms only.

Tool inputs are processed for the response without an application database or saved search history. Website-interface selections remain in page memory until the page is reloaded or closed. The guide has no application-added analytics, advertising trackers, cookies or browser-storage features. These statements describe the guide’s application code; they do not mean that ChatGPT, authentication or hosting providers keep no operational records.

ChatGPT and its hosting/authentication services process information under the terms and settings applicable to your OpenAI account. Your ChatGPT conversation and platform records may remain after you disconnect the guide. See OpenAI’s Privacy Policy and your ChatGPT data controls. 4. How information is used

Website information supports responding to inquiries, preparing quotations, discussing yachts and equipment, arranging visits or boardings, administering proposal access and follow-up, operating games, understanding website usage, and maintaining the services. Buyer-guide inputs are used to answer the tool request. We may also handle relevant records to meet applicable legal obligations or address a dispute or security issue.

The website inquiry forms do not automatically subscribe you to a mailing list. You can tell us if you no longer want sales follow-up.

5. Service providers and other recipients

• FormSubmit and email services. Website quotation forms and concierge inquiries are sent through FormSubmit for delivery to jb@ellingyachts.us and processing by the receiving email service. See FormSubmit’s privacy terms.
• Resend. Private proposal activity and response notifications are sent through Resend to jb@ellingyachts.us. These include the proposal and contact details, activity time, and any response or comments described above. See Resend’s Privacy Policy.
• OpenAI Sites and Cloudflare. These services provide hosting, delivery and related infrastructure. The backgammon game uses a hosted Cloudflare database. The buyer guide also uses Sites authentication and ChatGPT tool connectivity. See OpenAI’s Privacy Policy and Cloudflare’s Privacy Policy.
• Google Analytics and YouTube. Google Analytics measures website usage. Some yacht pages embed videos using YouTube’s privacy-enhanced domain. Loading or interacting with those videos can send technical and interaction information to YouTube/Google. See Google’s Privacy Policy.
• Other game players. A backgammon opponent can see your chosen player name, game state and moves. Use a nickname if you prefer, and share table links only with people you intend to invite.

Customer records and the factory. We may keep inquiry and customer records in HubSpot and share relevant information with Elling Shipbuilding b.v., the yacht factory, to discuss your requirements and support quotations and follow-up. See HubSpot’s Privacy Policy.

We do not sell or rent leads or use leads for targeted advertising. The service-provider processing described in this notice still applies.

Independent sites linked from our services, including factory, show and ticketing sites, have their own privacy practices. These providers may process data in the United States and other countries; their own notices describe their processing.

6. Cookies, local storage and analytics

• Proposal access: an access cookie lasts up to seven days and cannot extend the server-side proposal deadline; a separate notification-suppression cookie lasts up to one year. Server-side activity records suppress repeated proposal notifications.
• Backgammon: a player-identity cookie lasts up to one year. The browser saves the last table identifier and language preference locally until cleared or changed.
• Star Patrol: the browser stores game preferences and best-score information locally until cleared. Other game state may last only for the open page.
• Google Analytics: public website pages load Google’s analytics code, which can use cookies and similar identifiers to measure visits and interactions. The retention of Analytics records is determined by the property configuration and Google’s policies; it is separate from our email and customer-record retention.

Browser controls can block or delete cookies and local storage. Doing so may sign you out of a private proposal or prevent you from resuming a game. Google’s Analytics opt-out browser add-on is another available control for supported browsers.

The current website does not implement a separate response to browser Do Not Track signals or Global Privacy Control signals. Providers embedded in or linked from the site may collect information about your activity under their own policies. Please contact us about a privacy request or preference that browser controls do not address.

Private proposal pages do not load Google Analytics or send proposal-response events to it. They also suppress referral information when following links. Public-page analytics does not receive a named private-proposal referrer from these pages.

7. How long information is retained

We retain underlying inquiry, customer, email, CRM and proposal records until we manually delete them, subject to applicable legal requirements and privacy requests. There is no fixed automatic deletion schedule for those business records. Online proposal access normally lasts 30 days from issue, with an additional 30 days available when we approve an extension. That access period is separate from how long we retain the underlying records, and expiry does not remove copies already downloaded.

The buyer guide does not save application-owned copies of search inputs, fit preferences or results after request processing. Copies in ChatGPT and provider operational records are governed by the applicable platform settings and policies.

Backgammon rooms, chosen names and saved game state have no automatic expiry in the current application and remain until removed. Clearing your browser data does not delete a saved game from the server. Contact us with the table link if you want to request removal. Cookie and local-storage lifetimes are described above.

Provider copies, security records and backups may have separate retention arrangements. Browser cleanup or disconnecting the guide does not automatically erase information already delivered in email or retained by a provider.

8. Your choices and privacy requests

You can browse most yacht information without submitting a form. You can stop using or disconnect the buyer guide through ChatGPT, clear website browser data, and ask us to stop sales follow-up.

Email jb@ellingyachts.us to ask about, access, correct or delete information you have provided, or to raise a privacy concern. Identify the service and information involved, without sending sensitive identity documents in an ordinary email. We may need proportionate information to verify the request and locate the relevant records.

Your rights depend on your location and the laws that apply, and some records may need to be retained for legal reasons. Nothing in this notice limits rights you have under applicable law. For data controlled by a third-party service, its own privacy-request process may also be relevant.

9. Children and security

Our yacht sales and buyer-guide services are intended for adults. Courtesy Games do not require a child’s real name; use a nickname for a game. Please do not submit personal information about a child under 13. If you believe such information has been submitted, contact us so we can address it.

No website, email system or online transmission is completely secure. Use private proposal and game links carefully, and do not use these services to send information that is not needed for the request.

10. Updates and contact
